You will be paid the exact amount quoted to you on our website as long as your iPod arrives at our address in the condition you specified during the quoting process.

You will receive the full amount of the quoted value of your iPod via PayPal or email (for Amazon Gift Card). This amount will be sent to you within 5 days of receiving and inspecting your item, unless your iPod arrives in a condition that differs from what was specified during the quoting process. Please be aware that NO OFFER MADE IS BINDING AND WE RESERVE THE RIGHT TO DENY ANY PRODUCT FOR ANY REASON.

Your iPod must be shipped within 5 business days of receiving the provided packaging. If your iPod is not shipped within the 5 business days, your offer may no longer be valid, in which case we will reassess the value of your iPod and email you our reassessed value. If you decline our offer, we will return your iPod free of charge. If you accept our offer, you can expect full payment of the reassessed price within the time period listed above.

By agreeing to these Terms and Conditions and by shipping your iPod to us, you are verifying to us that you are the legal owner of the iPod.

We determine the final value of your iPod through our standard iPod inspection process. If there is a discrepancy between the reported condition of your iPod and inspected condition of your iPod, you will be contacted via your supplied email address and given the choice of accepting our new offer or having your iPod returned, free of charge.

You are responsible for properly packaging your iPod in the supplied packaging. You are solely responsible for damage caused during shipping, even if it is not your fault. The inspection process and final valuation is completed after the item is received, and therefore we cannot be held liable for items damaged in the shipping process.

By sending your item to us, you accept that you are fully responsible for the risk of damage or loss of your property, regardless of whether you are shipping to us, or we are returning your item to you.

We will do our best to remove all of your personal data from your iPod and overwrite it with new software. This will be done using the Restore option in iTunes. Although we do guarantee that your iPod will be processed using this software during the data removal procedure, we are not to be held liable for any data that is left on your iPod.

We are not responsible for any damages or losses suffered by you for your failure to properly back up your iPod, or the software’s failure to properly destroy all personal information.

You are legally and contractually bound to sell us the iPod should you be given an online quote via our website and we, after inspection, agree to pay that quoted amount.

Should we, after inspection of your iPod, conclude that there is an inconsistency between your reported and actual description of your iPod, you will be sent a revised quote for your iPod. You will have seven days to either accept or reject the price quote. If you reject the price quote, or don’t respond to our email within seven days, your iPod will be returned to the address you provided.

You must have 100% ownership of the iPod in which you are selling to us. By sending your iPod to us, you verify that you are not violating any law, regulation, or statute of any jurisdiction. You may not unlawfully transfer or encumber any intellectual property, trademark, copyright, patent, software, license, or other legal right or restriction via your selling or shipping of item. Your shipped item MUST be free of all legal restrictions that would affect the value of the item, your legal right to transfer ownership of the item (including the item itself, hardware on or inside the item, or software present on the item). You must avoid violating any export restrictions or laws. The item you send (including all other items included in your shipment) may not be counterfeited, fake, stolen, or contain offensive or harmful content of any nature. You agree to hold us harmless and compensate us from any and all losses of any nature. This includes fees, costs, judgments, liens and reasonable attorney fees (that may arise from any threatened or actual legal action should you violate this term and condition of this Agreement).

Failure to Return Product or Contents Thereto. Under certain limited circumstances, at no fault of ours, we may not be able to return your iPod and you agree not to hold us harmless from any loss regarding our failure, when outside of our control, to return your iPod to you. We will never, under any circumstance, duplicate or return any software or data contained on your iPod.

Legal title of your device passes to us when we agree to pay you the originally quoted amount as shown on our website or you agree to accept a lower offer that we make you. All decisions about whether or not we purchase your iPod and for what dollar amount are final. Any offer to purchase your iPod that we make is a non-transferable offer and also expires if not accepted by you in a timely manner, as described herein. At any time we may decide, without prior notice, to discontinue purchasing any particular or all items.

Errors. Should we make a material error in any representation of facts, information or offers to you, your sole recourse is to request the return of the iPod that you have sent to us. Your ability to request the return of the iPod elapses upon your receipt of the payment we issue for your iPod. In the event that you elect to cancel the transaction prior to receiving our payment, we will return the iPod to you upon your request.

Entire Agreement. No Waiver. This Agreement constitutes the entire agreement between the parties. Captions are used only as a matter of convenience and have no legal import. No waiver by us regarding any breach or default shall be deemed to be a waiver of any preceding or subsequent breach or default. Our website or other publications and communications may contain errors. We reserve the right to correct any errors in writing or orally with you.

Modification. We reserve the right to modify this Agreement at any time without giving you prior notice. Your use of our website, any of our tools and services, following any such modification constitutes your agreement to follow and be bound by the Agreement as modified. The last date these Terms of Service were revised is set forth below. Terms and conditions modifying the Agreement are effective immediately upon publication.
